1. Scope
These terms govern use of [[LEGAL_ENTITY_NAME]]'s website and of the Noa service. Using the site constitutes acceptance. Paid service is governed by a separate written agreement; where the two conflict, the signed agreement prevails.
2. The service
Noa provides AI voice agents that answer telephone calls on a business's behalf, connect to its existing telephony infrastructure, and perform actions in systems it chooses to connect.
The service is delivered as set out in the applicable agreement. Capability descriptions on this site are general and are not a representation of fitness for any particular purpose.
3. Site content and performance statements
Content on this site is provided for information. Performance figures, response times and outcomes shown reflect particular measurements or scenarios and are not a commitment to equivalent results in another environment. Actual results depend on line quality, call characteristics, configuration and other factors.
4. Customer obligations — caller notification and call recording
This is the most consequential section of this document. Read it carefully.
The service records and transcribes every call it handles.
The customer represents and undertakes that:
1. It will inform callers to its lines, clearly and in advance, that the call is recorded and processed by automated means — including, where required, by an announcement at the start of the call; 2. It will comply with every notification, consent and disclosure obligation applicable to it, including under the Israeli Protection of Privacy Law, 5741-1981, and the Secret Monitoring Law, 5739-1979; 3. It is the Controller of personal data arising from those calls, and Noa processes such data on its behalf and on its instructions; 4. It will not operate the service in any manner, volume or sector in which law prohibits it or conditions it on a requirement that has not been met.
Noa does not currently play an automated recording notice to callers. The customer must not rely on the system to discharge its notification duty.
The customer shall be responsible for any claim, demand or penalty arising from breach of this section.
5. Prohibited uses
The service may not be used to: contact anyone who has asked not to be contacted; impersonate a person or organization; solicit by deception; collect data without a lawful basis; interfere with the system's operation or attempt to circumvent its security controls; or for any unlawful purpose.
The customer shall not present the voice agent as a human where a caller expressly asks whether they are speaking with a person.
6. Intellectual property
All rights in the service, the software, the site design and the marks are reserved to Noa. The service may not be copied, reproduced, reverse-engineered, or used to create derivative works.
Content the customer supplies to the system — including configuration, scripts and call data — remains the customer's.
7. Warranties and limitation of liability
The service is provided AS IS. Except as expressly stated in the applicable agreement, we do not warrant that it will operate uninterrupted or error-free. AI systems can produce incorrect output; the service must not be relied on as a substitute for human judgment in consequential decisions, and must not be used for emergency purposes or in any situation where failure could cause physical harm.
Our aggregate liability shall not exceed the amounts actually paid for the service in the twelve months preceding the event. We shall not be liable for indirect or consequential loss, or for lost profits.
8. Security and security incidents
We apply the security measures described in our Privacy Policy. If a security incident affects a customer's data, we will notify that customer without undue delay and provide the information it reasonably requires to meet its own reporting obligations.
9. Termination
A customer may terminate in accordance with its agreement. On termination, and at the customer's request, we will delete its call data or make it available for export, subject to retention obligations imposed on us by law.
10. Changes to these terms
We may update these terms. Material changes will be posted on this site; continued use after posting constitutes acceptance.
11. Governing law and jurisdiction
These terms are governed by the laws of the State of Israel, and the competent courts in Israel shall have exclusive jurisdiction.
